We have extensive experience in insurance coverage litigation in a wide variety of matters concerning the construction industry, as well as ownership and development of real property. In a recent major construction litigation matter we obtained over $1 million in coverage where the liability carriers for the general contractor and subcontractors had refused to participate in the settlement of the underlying litigation. In another, we negotiated a joint-defense agreement in which the subcontractors' carriers agreed to provide a defense for our contractor client.

In our experience, obtaining insurance coverage often requires that the insured take an early and aggressive posture towards its carriers. Insurance carriers should be put on notice as soon as a demand is made, and before a lawsuit is filed. If a problem arises on your construction project, advise your insurance broker promptly.
